New employers’ liability laws come into force

The laws governing employer's liability have changed, as the government seeks to cut the cost of doing business.

On 1st October, amendments to the Employers’ Liability (Compulsory Insurance) Regulations 1998 came into force that made it legal to display liability insurance certificates in electronic form, as long as this is accessible to employees.  Employers also no longer have to retain copies of the certificates for 40 years.

The government estimates that the requirement to display and retain liability insurance previously cost businesses around £71 million per year. The aim of the new amendments is to contribute towards reducing this by 25%.
